§ 1. General Provisions
- These Terms of Service govern the use of the website operated by Delta Market Intelligence SIA and the provision of market intelligence services. They constitute a binding agreement between the User and the Service Provider.
- By accessing the website or commissioning a service, the User confirms that they have read, understood, and agree to be bound by these Regulations.
- The Service Provider reserves the right to amend these Regulations at any time. Users will be notified of significant changes via the website.
- These Regulations and any services provided hereunder are governed by the laws of the Republic of Latvia. Any disputes shall be resolved by the competent courts in Rīga.
§ 2. Definitions
- Website – The internet service available at deltamarket.eu, operated by the Service Provider.
- User/Client – A legal entity, organizational unit, or individual with legal capacity who uses the Website or commissions Services.
- Client Portal – A personalized section of the Website accessible to the Client for managing Services and accessing reports.
- Services – The market intelligence and research services provided by Delta Market Intelligence SIA as detailed in a project proposal.
- Regulations – These Terms of Service.
§ 3. Type and Scope of Services Provided
- The Service Provider offers bespoke market intelligence services, including competitor analysis, market forecasting, and custom research. The specific scope of any Service is defined in a separate proposal or statement of work agreed upon by both parties.
- All reports and data provided are for the Client's internal use only and may not be republished, resold, or distributed without prior written consent from the Service Provider.
- The information provided in the Services is based on sources believed to be reliable, but the Service Provider does not guarantee its absolute accuracy or completeness.
- The Service Provider is not liable for any business decisions made by the Client based on the provided intelligence. The Services constitute informational and analytical support.
§ 4. Technical Requirements
- Access to the Website and Client Portal requires a device with internet access and a modern web browser (e.g., Chrome, Firefox, Safari) with JavaScript and cookies enabled.
- The Service Provider is not responsible for any malfunctions or incompatibilities of the User's hardware or software.
- The User is responsible for ensuring the security of their login credentials for the Client Portal.
§ 5. Rights and Obligations of the User
- The User agrees to use the Website and Services in accordance with applicable law and these Regulations. The User must not provide any unlawful content.
- The User agrees to provide accurate information when commissioning Services and to make timely payments as per the agreed-upon invoice terms.
- The intellectual property rights to all reports, data, and methodologies provided as part of the Services remain the property of Delta Market Intelligence SIA. The Client is granted a non-exclusive, non-transferable license for internal use.
- The User is prohibited from attempting to gain unauthorized access to the Website's systems or interfering with its operation.
- The Client is responsible for maintaining the confidentiality of the information and reports provided by the Service Provider.
§ 6. Final Provisions
- If any provision of these Regulations is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- These Regulations constitute the entire agreement between the User and the Service Provider regarding the use of the Website.
- For matters not covered by these Regulations, the relevant provisions of Latvian law, particularly the Civil Law, shall apply.
